Distance Sales Agreement

1. PARTIES

This Distance Sales Agreement ("Agreement") is entered into electronically between the SELLER specified below and the BUYER who places an order through the website www.bubawater.com

BUYER

The information provided by the BUYER during the ordering process, including name, surname, address, telephone number and e-mail address, shall be deemed accurate and valid.

By placing an order, the BUYER acknowledges and accepts the terms of this Agreement.

 

2. SUBJECT

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of Buba Water branded products ordered electronically by the BUYER through www.bubawater.com/tr.

3. PRODUCT AND PRICING INFORMATION

The essential characteristics of the products, sales prices, payment methods, delivery information and any shipping charges are specified on the order summary page and invoice.

Products offered for sale include:

  • Buba Water Caffeinated Water 414 ml

  • Different quantity and package options of the same product

Unless otherwise stated, all prices displayed on the website include applicable VAT.

 

4. PAYMENT

Payments are securely processed through the iyzico payment infrastructure using credit cards or debit cards.

Products will not be shipped until full payment has been received and approved.

 

5. DELIVERY

Orders are prepared and shipped after payment confirmation.

Under normal circumstances, orders are dispatched within 1 business day.

Deliveries are carried out exclusively within the Republic of Türkiye through Aras Kargo.

Except in cases of force majeure or delays caused by the shipping carrier, delivery shall not exceed the legal period of 30 days.

 

6. INVOICING

An electronic invoice (e-Invoice or e-Archive Invoice) shall be issued for each order.

Invoices are prepared based on the information provided during the ordering process and delivered electronically in accordance with applicable legislation.

 

7. RIGHT OF WITHDRAWAL AND RETURN POLICY

Due to the nature of food and beverage products, and because their suitability for resale cannot be verified after delivery for health and hygiene reasons, returns are only accepted under the circumstances listed below.

The BUYER may request a return if:

  • The product is damaged during shipment;

  • The product is delivered in a damaged condition;

  • The product is delivered incomplete;

  • The wrong product is delivered.

In such cases, the BUYER must contact the SELLER within 48 hours of delivery by sending photographs and order details to info@bubawater.com.

Upon approval of the claim, the SELLER may either issue a refund or send a replacement product.

For approved returns, all return shipping costs shall be covered by the SELLER.

 

8. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal cannot be exercised for:

  • Products whose packaging has been opened;

  • Products with broken security seals or protective labels;

  • Consumed or used products;

  • Products that are no longer suitable for resale after delivery;

  • Food and beverage products that cannot be resold due to hygiene and health considerations.

 

9. FORCE MAJEURE

The SELLER shall not be held liable for delays or failure to perform obligations resulting from events beyond reasonable control, including but not limited to natural disasters, war, strikes, pandemics, transportation interruptions, governmental actions, or other force majeure events.

In such cases, the BUYER shall be informed and offered the option to cancel the order or wait until the circumstances are resolved.

 

10. PERSONAL DATA PROTECTION

Personal data provided by the BUYER during the ordering process shall be processed and protected in accordance with applicable data protection laws and regulations.

Detailed information is available in the Privacy Policy and Personal Data Protection Notice published on the website.

 

11. DISPUTE RESOLUTION

Any disputes arising from this Agreement shall be subject to the jurisdiction of the Consumer Arbitration Committees and Consumer Courts authorized under the laws of the Republic of Türkiye.

 

12. EFFECTIVENESS

By placing an order through www.bubawater.com, the BUYER declares that they have read, understood, and accepted all terms and conditions of this Agreement.
